(Last resort).<\/li><\/ul><h2 class=\"wp-block-heading\">Long Answer<\/h2><h3 class=\"wp-block-heading\">What is the problem, anyway?<\/h3><p>While national and European legislation allows for Spanish citizens and EU\/EEA citizens, as well as their family members, to enter and exit without the need for passport stamps \u2014or, indeed, even passports\u2014 any third country national not specifically exempted <strong>must have their passport stamped<\/strong> upon entering Spain. Unfortunately, there are three cases in which you may not have had your passport stamped:<\/p><ol class=\"wp-block-list\"><li>You crossed an <strong>external border<\/strong> (\u201cexternal border\u201d means a border between a Schengen Area state, in this particular case Spain, and a non-Schengen Area state, such as the United States of America) directly into Spain, but border guards <strong>simply didn\u2019t stamp your passport with an entry stamp<\/strong>.<ul class=\"wp-block-list\"><li><strong><em>Example:<\/em><\/strong><em> You fly from Shanghai to Madrid and border guards simply wave you in upon seeing your blue eagle passport.<\/em><\/li><\/ul><\/li>\n\n<li>You crossed an <strong>external border<\/strong> generally, then made your way to Spain by any means of transportation.<ul class=\"wp-block-list\"><li><strong><em>Example:<\/em><\/strong><em> You take a boat from Izmir (Turkey) to Thessaloniki, whose border guards may or may not have stamped your passport, then fly \u201cinternally\u201d from Athens to Barcelona.<\/em><\/li><\/ul><\/li>\n\n<li>You crossed an <strong>internal border<\/strong> (\u201cinternal border\u201d means a border between Schengen Area states).<ul class=\"wp-block-list\"><li><strong><em>Example:<\/em><\/strong><em> Having completed your holiday in Lisbon, you drive back from Lisbon to your flat in Seville.<\/em><\/li><\/ul><\/li><\/ol><p>In any of these cases, <strong>Spanish authorities may presume you to be in Spain irregularly<\/strong>, that is, without meeting the legal requirements to be present in Spain. This isn\u2019t merely a hypothetical problem: it\u2019s happened before (see below).<\/p><figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXe6l_TJAyrXJ72qyP4Hrpwv0gtR9GIuZtj7opt8ZQj8UX-QW8SZVvq6-J3bFnAAspKwBx_iGhOhNyadmdgTVK7Rdtx-ffmrfLUkCLcXeW1hbTo1zWKplT9dufuHJMFyGxpU3b2ZnDnQcbMulU1Je8jkI7Do?key=eN4EOegMhdTNnxb73nWkQA\" alt=\"\"\/><\/figure><p>(This is an actual denial of residence received by an actual foreign citizen for not having a Spanish entry stamp on their passport).<\/p><h3 class=\"wp-block-heading\">Do I need a stamp?<\/h3><p>Essentially, the only people who don\u2019t need passport stamps are:<\/p><ul class=\"wp-block-list\"><li>Spanish citizens, who may enter Spain with a passport or with a DNI.<\/li>\n\n<li>EU\/EEA citizens, who may enter Spain with a passport or with their national ID.<\/li>\n\n<li>Family members of Spanish or EU\/EEA citizens with a valid EU family member residence card.<\/li><\/ul><p>If you don\u2019t fall into one of these categories, you most likely need a stamp.<\/p><h3 class=\"wp-block-heading\">What can I do, then?<\/h3><h4 class=\"wp-block-heading\">1. Try to avoid the problem in the first place by asking border guards, politely but firmly, to stamp your passport.<\/h4><figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXeWgEIa4D9NaIM06Q0UqPmLgQCb-xqRCVkfznHADhr4hK3qtGs9TIKbPYmernUrVNHdPceXmUL69sA1PUFuHEF8nbHJTYGV73hBMzGUagDcJVrr72FCeicOfZRjg_L1VHgdBRUsUi3NowkM111NfSUJxEdO?key=eN4EOegMhdTNnxb73nWkQA\" alt=\"\"\/><\/figure><p>(A foreign citizen dutifully obtaining an entry stamp at an external border. We don\u2019t actually know where this is, but it looks close enough.)<\/p><p>This option only really applies to case 1, crossing an external border directly into Spain.<\/p><p>As usual, show the border guard at your point of entry your passport, your TIE, and, if applicable, your return authorization (<em>autorizaci\u00f3n de regreso<\/em>). If the border guard waves you through without stamping your passport, politely but firmly ask the guard to stamp your entry in Spain on one of the available pages on your passport. You can always blame Extranjer\u00eda \u2014 \u201c<em>es que en la Oficina de Extranjer\u00eda me dijeron que era necesario<\/em>\u201d \u2014 or your lawyer.<\/p><p>Usually, this\u2019ll suffice and the border guard will, begrudgingly, acquiesce. The exchange may be unpleasant, but you\u2019ll save yourself a lot of grief (see below).<\/p><h4 class=\"wp-block-heading\">2. Alternatively, declare your entry at the nearest police station to your point of entry upon entering.<\/h4><figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXcUCEjqm1ucGcRpRUaDFheTHGP0SM-gdTRxr4AMn8x6A9B9OHerOoMFCcJARED6QU-GyfFENVOjv9asf4nxVM1G1tmq_DF9BKiqJUXBHM9qyyVfOHaUxyqMjM7teGFTnfbvHcneJyzTnE2OnUcom_jXX3ti?key=eN4EOegMhdTNnxb73nWkQA\" alt=\"\"\/><\/figure><p>(<em>Aeropuerto Adolfo Su\u00e1rez Madrid-Barajas<\/em> has a National Police precinct on-site. Ask a staff member to direct you there!)<\/p><p>This option only really applies to case 1.<\/p><p>If the border guard at your point of entry refuses to stamp your passport, you\u2019re not out of luck. Major points of entry, such as <em>Aeropuerto Adolfo Su\u00e1rez Madrid-Barajas<\/em>, have National Police stations on-site. Ask port of entry staff to point you to the <em>comisar\u00eda de la Polic\u00eda Nacional<\/em> \u2014<strong>not<\/strong> <em>Guardia Civil<\/em>.<\/p><p>You\u2019ll need your passport, TIE (if you have one), return authorization (if you have one), proof that you\u2019ve just arrived (e.g., your airline ticket), and a form called \u201c<em>DECLARACI\u00d3N DE ENTRADA EN TERRITORIO ESPA\u00d1OL<\/em>\u201d (which you can download <a href=\"https:\/\/www.inclusion.gob.es\/documents\/d\/migraciones\/declaracion-de-entrada-en-territorio-espanol-art-13-reloex-1\">here<\/a>).<\/p><p>As with the border guards, your friendly copper may tell you:<\/p><ul class=\"wp-block-list\"><li>That filing a declaration isn\u2019t required,<\/li>\n\n<li>That you can always do it later,<\/li>\n\n<li>That they don\u2019t particularly want to do it,<\/li>\n\n<li>Etc.<\/li><\/ul><p>Once again, politely but firmly insist that you\u2019d like to file your declaration of entry. Blame it on us, on your lawyer, on the Immigration Office, etc.<\/p><p>Usually, this\u2019ll suffice and the officer will, begrudgingly, file your declaration of entry and provide you a document proving your filing.<\/p><h4 class=\"wp-block-heading\">3. Alternatively, declare your entry at police stations or immigration offices within three business days of entering.<\/h4><figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXf3FJNthkEREwZehzyNVMyDBxbQZLQZcA3Rw1R1VZglj9YdtDJ-sMtrD3a6MVdQ0Ttr5abXNWhoEDJL3SUg6zFvdoUxk81INXmpuGiy5IWDBkfd-XjYyTziRQ1tBlJQAYdTQoXfscbmYCUXj-nd8vIkXBVa?key=eN4EOegMhdTNnxb73nWkQA\" alt=\"\"\/><\/figure><p>(A Spanish National Police precinct.)<\/p><p>You\u2019ve tried finessing border guards, you\u2019ve tried persuading the police at your point of entry, and you\u2019ve come up with a big fat zero? Don\u2019t panic.<\/p><p><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2011-7703&amp;p=20240304&amp;tn=1#a13\">Article 13<\/a> of the Spanish immigration regulation gives you <strong>three business days<\/strong><em> (<\/em>\u201c<em>d\u00edas h\u00e1biles<\/em>\u201d) to file a declaration of entry. \u201cBusiness days\u201d means any day excluding Saturdays, Sundays, and official public holidays in your Spanish place of residence \u2014if you don\u2019t yet reside in Spain, use the public holidays of the city in which you\u2019re staying. <em>This is an important point. Many police officers will insist that you must\u2019ve filed your declaration of entry within three <\/em>calendar<em> days. Sometimes this is a misunderstanding of the regulation, sometimes it\u2019s a way to avoid having to do work. Politely but firmly insist that the regulation clearly says <\/em>business days<em>; show them article 13 of the regulation if necessary.<\/em><\/p><p>As with option 2 above, you\u2019ll need your passport, TIE (if you have one), return authorization (if you have one), proof that you\u2019ve just arrived (e.g., your airline ticket), and a form called \u201c<em>DECLARACI\u00d3N DE ENTRADA EN TERRITORIO ESPA\u00d1OL<\/em>\u201d (which you can download <a href=\"https:\/\/www.inclusion.gob.es\/documents\/d\/migraciones\/declaracion-de-entrada-en-territorio-espanol-art-13-reloex-1\">here<\/a>).<\/p><p>In principle, you can file this declaration at <strong>any<\/strong> National Police precinct, as well as at Immigration Offices. You can search for police precincts <a href=\"https:\/\/www.policia.es\/_es\/dependencias_localizador_accesible.php\">here<\/a>. Police precincts with specific immigration faculties can be found <a href=\"https:\/\/www.policia.es\/_es\/dependencias_localizador_accesible.php#li_extranjeria\">here<\/a>.<\/p><p>Your <em>funcionario de turno<\/em> may, for example, tell you:<\/p><ul class=\"wp-block-list\"><li>That they can\u2019t stamp your passport and wish to send you away, in which case you may wish to tell them that you\u2019re not asking for a passport stamp, you\u2019re asking for a declaration of entry;<\/li>\n\n<li>That the three days started counting upon your entry into the Schengen Area (say, in France), in which case you may wish to tell them article 13 is <strong>specifically<\/strong> about entering Spain; or<\/li>\n\n<li>That you\u2019re not required to file a declaration of entry, in which case you can blame your fictitious, hard-nosed lawyer, a previous bad experience with the Immigration Office, etc.<\/li><\/ul><p>If all goes well, the officer will, almost always begrudgingly, file your declaration of entry and provide you a document proving your filing.<\/p><h4 class=\"wp-block-heading\">4. Alternatively, save convincing evidence of your arrival. (Last resort).<\/h4><figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXec1QjC8momiBwVG6FsqiZqFuRKZffsiZFs3Rws3muE_ZRPzi1EjPnfdXHl2ZB4OZ3HsJxSzGKshjEw9OTHfIEbWpn7Cq-2WfgIYYd5CLUDOGbyZP7QyhdGdVGNjATKqTNBwP7srVCFQxpG8pSBJTaGm24?key=eN4EOegMhdTNnxb73nWkQA\" alt=\"\"\/><\/figure><p>(This is what we want to avoid.)<\/p><p>If all else fails, and very much as a last resort, you can collect and store convincing evidence of your arrival in Spain. You see, while <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A02016R0399-20240710#tocId35\">article 12<\/a> of the EU Schengen Border Code allows states to <strong>presume<\/strong> your irregularity, this presumption <strong>can be rebutted<\/strong>.<\/p><p>What types of evidence are convincing and tend to prove your arrival in Spain? While there\u2019s no set, limited list of evidence \u2014our legislation specifically refers to \u201cany evidence admissible in law\u201d\u2014 we recommend the following:<\/p><ul class=\"wp-block-list\"><li>Your boarding pass, train or ferry ticket, or any other such document identifying <strong>you<\/strong>, the <strong>date<\/strong> and the <strong>place<\/strong> of entry in Spain.<\/li>\n\n<li>Bank records showing <strong>you<\/strong> made a transaction immediately upon or shortly after arriving in Spain, showing the <strong>date<\/strong> and <strong>place<\/strong> of the transaction.<\/li>\n\n<li>Uber or Cabify receipts show <strong>you<\/strong> traveled with them immediately upon or shortly after arriving in Spain, showing the <strong>date<\/strong> and <strong>place<\/strong> of your travel.<\/li>\n\n<li>Work, school, or medical attendance records showing that <strong>you<\/strong> attended immediately upon or shortly after arriving in Spain, showing the <strong>date<\/strong> and <strong>place<\/strong> of your attendance.<\/li>\n\n<li>A selfie, ideally uploaded to a social medium like Instagram, immediately upon or shortly after arriving in Spain, and, ideally, in front of a recognizable landmark (e.g., in front of the <em>Ayuntamiento de Madrid<\/em>).<\/li><\/ul><p>More is more.<\/p><p>Your collection of evidence can be used in immigration and citizenship procedures where a date of entry is in question.<\/p><p>If you\u2019d like to confirm whether you\u2019re exempt from passport stamp requirements (and, soon, EES entries), if you\u2019d like to discuss the alternatives to passport stamps provided in this article, or if you\u2019d like to discuss what to do in case none of these options is viable for you, consult a lawyer.
