Introduction

Spanish legislation, especially Law 34/2002, of 11 June, requires us to provide you with certain information; we also have to cover our asses. We have to give you this very lengthy Legal Notice (“Notice”). We’re sure you understand, although we would admire you more if you didn’t.

Users

You’re a “User” if you were born or formed/incorporated and if you access, browse, or otherwise interact with the information, images, source code, text, or other content hosted on Continentalis.eu (the “Site”).

You’re a good User if you use the Site in good faith, in such a way that your mother would be proud, or, at least, in such a way that doesn’t violate any laws. By continuing to use this Site, you agree to be a good User.

If you aren’t a good User, Continentalis or a third party may hold you liable for any torts caused as a result.

Modifications

The Site is ours. That means, among other things, that we can change its contents at any time, except where a specific contractual or legal obligation requires us to maintain certain contents.

Unless you’ve hired us to provide you with services, ours is a fleeting relationship: the relationship lasts only as long as you remain a User. Because we can change the contents of the Site, including this Notice, at any time, you agree to come back and read this Notice, our Privacy Policy, and all other contracts and legal notices on the Site, every time you’re a User. As this is the sad, sad world lawyers like this one have created, we’ll hold you to this.

Conditions for Use

We’ve made this Site available to you and other Users to access free of charge, barring any clients-only areas or features, which may require payment.

Don’t use the Site in any way which violates the law or any of the conditions set forth in this Notice or elsewhere on the Site. If you do, you must assume the consequences.

Use of our Site may entail the filling in of forms with your personal data. You agree to provide us with accurate information; we can’t be held liable if you don’t follow this obligation. If the information you provide us is inaccurate, false, fraudulent, or illegally obtained, there’ll be consequences ranging from our disappointment to prosecution.

You, the User, take on the following obligations:

  • Abstain from disseminating criminal, violent, racist, xenophobic, offensive, or otherwise illegal content on or via our Site. We don’t really know how you would even do this. It isn’t that kind of a website. But whatever.
  • Abstain from attempting to —or succeeding at— infecting us, our Site, or any of our devices with viruses, worms, spyware, or other malware. Our managing partner has a very particular set of skills. She will look for you. She will find you and prosecute you.
  • Abstain from attempting to —or succeeding at— accessing our email accounts or other restricted areas. See above.
  • Abstain from DDoS-ing us or attempting to do so. See above.
  • Abstain from stealing our stuff. We admire those who sail the deep, blue seas! But we worked hard to produce the contents of our Site and don’t have the deep pockets that Paramount has. Don’t be a jerk.
  • Abstain from pretending to be someone you’re not. Especially you, CIA. You’re not welcome here. In fact, if you’re a three-letter-agency of any type, fuck off.
  • Abstain from reproducing, copying, distributing, or transforming our content without our permission.
  • Abstain from spamming us. Especially you, ORANGE ESPAGNE, S.A.U. In fact, if you’re a telecommunications company of any kind and you contact us for any reason other than in the performance of a contract we’ve already entered into with you, you expressly agree to pay us 3.000€+VAT per contact, which you must pay within fourteen (14) days of our billing you for those contacts. We will bill you. We will sue you if you don’t pay. You’ve been warned. (Notice to agent is notice to principal).

Our lawyer wants us to say that his fancy degrees are only good for Spanish and European legislation. We don’t know if our Site is in compliance with laws where you, the User, are accessing the Site—unless you’re accessing it in Spain. If you’re not accessing our Site from within Spain, you may be violating the laws of your host state. If accessing our Site is illegal where you are, perhaps consider moving. You deserve better.

If you need to contact us, you have a few options:

  • You can email us at info@continentalis.eu. We’d prefer this. We’re millennials and don’t like phone calls.
  • If you have to call us, though, you can use the phone number at the bottom of this page. Please don’t call us unless you have to. We’ll take your call, no problem. But email us instead.
  • If you’re so inclined, you can also send us paper email directed to Continentalis @ Calle de la Princesa 31, 2.º-2, 28008 Madrid, Spain.

Our contracts may stipulate specific forms of communications for specific contractually-relevant acts.

Personal Data Protection

We value privacy. We generally don’t collect more personal data than is absolutely necessary to offer you our services, and we promise to collect, process, and treat your personal data in accordance with
Organic Law 3/2018, of 5 December and European Regulation (EU) 2016/679, of 27 April.

Intellectual Property Rights

Except where content on our Site is in the public domain, or unless otherwise specified, all contents on this Site, including, but not limited to, text, photographs, graphics, graphical layouts, images, icons, (in conjunction, our “IP”), are belong to us. Don’t use them without our permission. If you use them without our permission, you expressly authorize us to bill you a penalty 3.000€+VAT plus any actual material damages caused, both of which amounts you hereby agree to pay within fourteen (14) days of billing.

If you want to use our IP, you should first contact us (see above) and ask for permission. We may give you permission to do so for free or for a fee.

Links to Other Sites

Our Site may, and probably does, contain links to other websites or Internet resources. We exercise caution in deciding what Internet resources to link to, but we can never be sure that the links will always link to what we intended to link to —that makes sense, right?— or that the contents of those external sites is accurate. We take no responsibility for other people’s content and you agree not to hold us responsible for other people’s content.

Disclaimers

The information on this site is “general information.” We strive to make our content as accurate and as useful as possible, but we may fuck up, from time to time. If we do, contact us and let us know at ifoundanerror@continentalis.eu.

We do our best to maintain a good up-time, but this is the Internet. Servers go down. You agree not to sue us or otherwise hold us liable for our site being down.

We’re not here to infect your devices with viruses, worms, spyware, or other malware. We’ll never do it of our own accord. If someone’s a bad User and injects one of these undesirables in our site, and that ends up on your device, you agree not only not to sue us, but to join ranks with us in pursuing the bad User, or else to pursue the bad User independently, if you so wish.

Applicable Law and Jurisdiction

Like we’ve said, the applicable laws are the laws of Spain and of the European Union. We don’t want beef, but, if you have one to squash, you agree to sue us only in the courts and tribunals of Madrid, Spain. By being a User of our Site, you expressly renounce any diplomatic or other immunities you may enjoy, both in declaratory and executory proceedings.
